(1) Except as otherwise provided in part 4 of this article for commercial drivers, no person shall operate a motor vehicle on a public highway in this state unless such person has been issued a current driver’s or minor driver’s license or an instruction permit by the department pursuant to this article. (2) Except as otherwise provided in part 4 of this article for commercial drivers, no person shall operate a motor vehicle on a public highway in this state unless such person has been issued a current driver’s or minor driver’s license (2) If a person’s driver’s license or minor driver’s license has been expired for one year or less and the person has not been issued a new driver’s license by the department or by another state or country as a result of the expiration, the person is prohibited from operating a motor vehicle on a highway in this state.

No person shall operate any motor vehicle on a public roadway in this state unless that person has in his or her immediate possession a valid driver’s license or minor driver’s license, or an instruction permit granted by the department in accordance with this article.

In this state, no individual who has been issued a presently valid driver’s license or minor driver’s license, or an instruction permit, should operate an automobile while the license or permit is not in his/her immediate possession on a public roadway in this state.

(1) If the defendant chooses not to pay the penalty assessment and, at or before the defendant’s scheduled court appearance, he or she exhibits to the court a currently valid license or permit issued to such person or an officially issued duplicate thereof in the event the original is lost, stolen, or destroyed, the charge of a violation of subsection (5) of this section shall be dismissed by the court.

(8) The conduct of a driver of a motor vehicle that would otherwise constitute a violation of this section is justified and not unlawful when:(a) it is necessary as an emergency measure to prevent an imminent public or private injury that is about to occur as a result of a situation that was not caused or developed as a result of the driver’s conduct and which is of sufficient gravity that, according to ordinary standards of intelligence and morality, the desirability and urgency of taking action outweigh the consequences of not taking (9) The question of justification or exemption is treated as an affirmative defense in this case.

According to this clause (9), “affirmative defense” indicates that, unless the state’s evidence raises the question surrounding the particular defense, the defendant must offer some credible evidence on that subject in order to raise the issue.

(12) If any provision of paragraph (1) or (4) of this section is violated, the violator is guilty of a class 2 misdemeanor traffic violation.

(11) Notwithstanding any other provision of law, a second or subsequent conviction under subsection (1) or (4) of this section in which the person who received the conviction has not subsequently obtained a valid Colorado driver’s license or a license of the appropriate type or general class will result in the department assessing six points against the driving privilege of the person who received the second or subsequent conviction.
