What is an “Occupational License”?

The court order is only valid for a short period of time and permits you to drive while your normal license is suspended. In most cases, it lasts for the duration of your suspension, which might be anywhere from three months to two years.

Is it only for driving to work?

No, the ODL also permits you to drive to and from school, to get groceries, to go to court, and to do other home tasks.

That sounds like almost all normal driving, right?

Yes. However, it does not include leisure activities such as going to the cinema, singing in a band, dining out, and so on.

Can I drive any time I want?

No. When we apply for the ODL, you will be required to select the hours that you will be required to drive. You have the ability to drive for up to twelve hours every day. For example, Monday-Friday from 8:00 a.m. to 8:00 p.m. and Saturday-Sunday from 10:00 a.m. to 10:00 p.m. are typical hours. You may also divide up the day’s hours into smaller chunks. For example, Monday 8:00 a.m.-2:00 p.m. and 5:00 p.m.-11:00 p.m. – as long as the total number of hours is twelve – is acceptable. We set the hours for a full week in advance, and these hours are valid for the whole suspension time, unless otherwise specified.

What if something changes and I have to adjust the hours after I get the occupational license?

Unfortunately, modifying the hours of operation after a judge has granted the ODL is quite challenging.

When do I get the Occupational License? Can I get it before my regular license is suspended?

We will apply for the ODL if and when your normal license is suspended – you will not be able to obtain it prior to the suspension taking effect. If you’ve been arrested for DWI, we’ll normally seek an ALR (Administrative License Revocation) hearing following the arrest. This means that your license won’t be suspended until after the hearing is completed. This might occur anywhere between three and eight months following the arrest. If the court finds against us during the hearing, we will begin working on obtaining an occupational license at that point.

How will I know when the ALR hearing is going to be?

We send out e-mails to keep you informed on the progress of the hearing. Due to the fact that DPS attorneys regularly request hearing rescheduling due to officers being in training, sick, or at another court hearing, we can never be certain that the hearing will take place when it was initially planned as scheduled.

How soon can you get the ODL?

Once you have provided us with all of the following papers, information, and signatures, it will take between 24 and 48 hours to have the ODL drafted and signed by the court.

Is getting an ODL an easy process for lawyers?

No. Obtaining an ODL is a time-consuming procedure that entails gathering the necessary papers and information, creating petitions and orders, submitting the petitions and orders, persuading a judge to sign the documents, obtaining certified copies, and forwarding them to the Department of Public Safety. We, on the other hand, are delighted to do it! Every week, we get an average of three ODL requests.

What if I give you some (but not all) of the documents and information you need? Can you get started?

Unfortunately, this is not the case. Everything is turned in to the clerk/DPS as a whole package.

What is a SR-22 certificate of financial responsibility?

SR-22 is a certification provided by an automobile insurance provider that verifies that you have the minimum liability coverage needed by the state of residence. It obligates the insurance company to alert DPS if you cease paying for liability insurance. For DPS (and the judge who granted the ODL) to be certain that you have liability insurance, it is known as a certificate of insurance.

Is it separate from regular insurance?

No. It is purchased in conjunction with liability insurance. When you get an SR-22, you’re also buying liability insurance for your vehicle. It is possible, however, to obtain a non-policy owner’s and SR-22 package from an independent insurance provider that will not conflict with your normal coverage in any way.

Where should I get it?

We are familiar with the individuals that operate Speedy SR-22. They’re fantastic! However, if you search for “SR-22 Texas,” a slew of firms will appear, giving you plenty of options.

Can I buy it from my regular insurance company? Will they raise my rates?

The SR-22 form can be obtained from your existing insurance carrier if they sell it. Unfortunately, I am unable to tell you whether or not this decision will have an impact on your rates. A non-policy owner’s and an SR-22 package from Speedy SR-22 are popular choices among our customers for these reasons.

What do I do with the proof of SR-22 insurance?

Please send us a copy. We’ll need to include it with your ODL application in order for it to be accepted. If you provide your insurance provider with our contact information, they will almost always send it to us.

If you have a Texas driver’s license, you can get your Arkansas driving record through the DPS website. You will need to refer to your license’s audit number, which is a 20-digit number. The fee is $22 per person. If you do not have a Texas driver’s license, you must order your driving record through the mail (this can take 2-3 weeks). Download the application form. In the top area, under “Check kind of record desired,” choose box 4, Abstract Record from the drop-down menu.

Then mail it to the Department of Public Safety (the address is on the form) with a $20 check or money order attached. If you have never had a Texas driver’s license, please contact our office at (512) 472-1113 and we can assist you.

How long after the ALR hearing do I have to get all the stuff together for the ODL?

After the ALR hearing, you will have a “grace period” of roughly 2-3 days before your suspension is processed by DPS and becomes effective. You have a lot of time – unless you have to order your driving record by mail because you don’t have a copy of your Texas driver’s license (and thus the audit number) or because you have never had a Texas driver’s license at all – to get everything to us. This is one of the reasons why we recommend that you obtain a second copy of your physical driver’s license if you have been arrested (assuming that the police took your license the day of the arrest).

The Department of Public Safety will not provide you with your audit number over the phone.

How do I check my license eligibility online?

After the court signs the decision suspending your license, it typically takes DPS 2-3 days to complete the license suspension procedure. If you have any questions, please contact DPS. I urge that you verify your license online after the hearing to ensure that your license is still available for use during the “grace period” after the hearing. Here is the link to see whether or not you are eligible for a license. This means that if the suspension has not yet been processed, the status will reflect “ELIGIBLE.” If you check the status of your license and it says “ELIGIBLE,” yet you see a suspension date listed below, it signifies DPS is aware that you are facing a pending suspension.

If the status indicates that you are “NOT ELIGIBLE,” the suspension has been completed and your license has been suspended.

Why do I bring a payment of $51 to you? Why not give it directly to the Justice of the Peace, Precinct 5?

Typically, it takes DPS 2-3 days to complete a license suspension once a judge has signed the decision suspending your privilege to drive. Immediately following the hearing, I strongly advise you to check your license online to ensure that you are still able to drive during the “grace period” Click here to see whether you qualify for a license. This means that if the suspension has not yet been processed, the status will be “ELIGIBLE.” If you check the status of your license and it says “ELIGIBLE,” but you see a suspension date listed below, it implies DPS is aware that you are facing a pending suspension and is working to resolve the situation.

If the status indicates that you are “NOT ELIGIBLE,” the suspension has been completed and your license has been revoked or suspended.

What about the $135 (for reinstatement fee and ODL fee)? Where do I pay that?

You will also be responsible for paying this cost to our office. As soon as we have submitted your completed ODL to DPS, we will send them a check from our office.

Personal money orders are more difficult to track down than office checks. We want to make sure we can trace the check in case DPS forgets to credit your account (sadly DPS has done this in the past) (unfortunately DPS has done this in the past).

Why do you mail it in and not me?

We will take care of mailing everything to DPS on your behalf. The reason for this is because many of our prior clients have either neglected to ship the documents to DPS or have completely lost track of them. This service is provided at no cost to you.

What counties can I put in the ODL? What if I have to drive to Houston/Dallas/El Paso?

For your convenience, we will ship everything through the USPS. The reason behind this is that many of our prior clients have either neglected to mail or have completely lost their documentation. Using our services is completely free.

Can I add counties after I get my ODL?

The petition for the ODL must be signed in person and notarized in order to be valid. However, you must be there to take advantage of our complimentary notary service. If you want to notarize the document yourself, we may e-mail you the document and you can return the original to us by postal mail.

The ODL says I have to keep a log book. What is that?

The judge has ordered you to keep a written record of the dates, times, and locations of each trip you take in your automobile. They have the right to ask to check your log book if you are pulled over by the police and they believe you have done something wrong. It has never been required of any of my clients previously, but it is one of the criteria for the ODL in terms of formal documentation.

Is the ODL just paperwork? Or does it look like a regular license?

In order to comply with the judge’s order, you must keep a log of all your driving activities, including the dates, times, and locations. Police officers have the authority to request to check your log book if you are pulled over by the authorities. It has never been required of any of my clients previously, but it is one of the prerequisites for the ODL in terms of technicality.

What if they don’t send me the license before the 45 days end?

This does happen from time to time. Call us and we’ll go through the alternatives with you. Most of the time, the license is received within a week or two. In some cases, we may be able to issue you an updated order to keep you covered while you wait for the actual copy to arrive.

What if I don’t want to get an Occupational License? It sounds expensive and inconvenient.

You are not required to obtain an ODL. You will not be able to drive lawfully throughout the suspension time if you do not have one. You will face another class B misdemeanor if you drive without an ODL and are caught by the authorities (Driving While License Invalid). For a variety of reasons, I have many clients who assess the advantages and disadvantages of using public transit, Uber or Lyft, a bicycle (or the Austin B-Cycle), or getting rides with friends during their suspension. If you have children or a work that is difficult to get to, this will be practically hard for you to do successfully.

Do I have to get an occupational license right away? Can I see how hard it is to use public transportation first?

You are not required to obtain an ODL immediately away. We can order one for you anytime you decide that you want one.
